If a room is ordered and confirmed, as an accommodation contract is concluded. A legally binding contract is also available in oral, in particular telephone bookings, unless expressly agreed in writing. 

The Conclusion of the contract commits both parties to fulfill the contract. The owner of the accommodation is required to provide the booked accommodation for the agreed period. The guest has to pay as contracted the accommodation price. 

A one-sided, free cancellation by the guest of a binding booking is generally excluded, if this the booked accommodation for reasons which fall within its sphere of risk, can not use (except for Force Majeure). 

The guest nevertheless withdraws from the contract, he is obliged, regardless of the date and reason for the withdrawal is to pay the agreed or customary price. The owner of the accommodation must, however, saved expenses (see above) set it off against his claim. From the jurisdiction of the value of the expenses saved at night is a flat rate lump sum fixed price with breakfast recognized with 20%, at night with half board with 30% at night with full board with 40% to be appropriate. 

The owner of the accommodation is stopped, an unused property re-let and must leave by the time saved credited against his claimed cancellation fee. 

The owner of the accommodation must provide the guest with a damages inflicted by his failure to provide the booked accommodation (eg due to overbooking). Only in cases of force majeure, such as natural disasters, the owner of the accommodation of the performance is free.
